1. Acceptance of these Terms
By accessing or using EILO.org, including its website, streams, pages, archives, submissions, player features and related services (collectively, the "Service"), you agree to be bound by these Terms of Use, as updated from time to time. If you do not agree to these Terms, you should not use the Service.

These Terms apply together with our Privacy Policy, Copyright Notice and Content Submission Terms, where applicable.

2. Description of the Service
EILO.org provides an online music and radio platform that may include live streams, DJ sets, recorded shows, artist pages, archives, editorial content, links, embedded players, user-submitted materials and related information.

EILO.org may change, suspend, restrict, discontinue or remove any part of the Service, temporarily or permanently, at any time and without prior notice.

3. Eligibility and use of the Service
You agree to use the Service only in a lawful manner and in accordance with these Terms. If account registration or submissions are enabled, you agree to provide accurate information and to keep your credentials secure.

You are responsible for all activity carried out through your account or credentials, unless caused by EILO.org's own fault.

4. Acceptable use
You agree that you will not:
- use the Service in violation of any applicable law or regulation;
- upload, submit, post or transmit material that is unlawful, misleading, fraudulent, abusive, defamatory, obscene, threatening, infringing or otherwise objectionable;
- submit content for which you do not have sufficient authority or permission to provide;
- interfere with, disrupt, damage, overload or compromise the operation, integrity or security of the Service;
- attempt unauthorized access to any part of the Service, server, account, network or related system;
- use scraping, harvesting, bots or automated means to extract data from the Service without prior written consent;
- impersonate any person or entity, or misrepresent your affiliation with any person, artist, label, organization or rightsholder;
- use the Service to distribute spam, malware, harmful code or deceptive communications;
- use the Service in a way that may expose EILO.org to legal or regulatory risk.

5. User submissions and contributed content
If you submit, upload or otherwise provide any audio, text, images, metadata, artwork, track listings, links or other material to EILO.org, you remain responsible for that material and for the accuracy of the information you provide with it.

Submission of content to EILO.org is also governed by the Content Submission Terms. In the event of conflict between these Terms and the Content Submission Terms regarding submitted content, the Content Submission Terms will prevail for that subject matter.

EILO.org reserves the right, but not the obligation, to review, refuse, edit, de-list, restrict, suspend, archive, disable access to or remove any submitted material at any time, with or without notice, particularly where rights, permissions, legality, identification or policy compliance are unclear or disputed.

6. Intellectual property
Unless otherwise stated, the website design, branding, logos, editorial text, visual layout, selection, arrangement and original materials of EILO.org are owned by or licensed to EILO.org and are protected by applicable intellectual property laws.

Third-party artist names, works, recordings, trademarks, logos and related materials remain the property of their respective owners and rightsholders.

No part of the Service grants you any ownership right or commercial license in relation to EILO.org or third-party materials except where expressly stated in writing.

7. Copyright and rights complaints
If you believe that any content made available through EILO.org infringes copyright, related rights or other intellectual property rights, please contact us at info@eilo.org or through Contacts.

EILO.org may act on rights complaints by reviewing, restricting, removing or disabling access to content, requesting additional information, or taking other appropriate action.

8. Third-party services and links
The Service may contain links to third-party websites, platforms, streams, embeds, tools or services. EILO.org does not control and is not responsible for the availability, content, policies or practices of third-party services.

Your use of third-party services is at your own risk and may be subject to separate terms and policies of those third parties.

9. Availability and technical operation
EILO.org does not guarantee that the Service, or any part of it, will always be available, uninterrupted, error-free, secure, compatible with your device, or free of technical faults, delays, data loss or harmful components.

Streaming availability may depend on third-party infrastructure, hosting, networks, directories, codecs, devices and other technical factors outside EILO.org's control.

10. Disclaimer
The Service is provided on an "as is" and "as available" basis to the fullest extent permitted by applicable law.

EILO.org makes no representation or warranty, express or implied, regarding availability, merchantability, fitness for a particular purpose, non-infringement, reliability, accuracy, completeness or suitability of the Service or of any content accessible through it.

Any reliance you place on the Service or on any content made available through it is at your own risk.

11. Limitation of liability
To the fullest extent permitted by applicable law, EILO.org shall not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, goodwill, business opportunity, data, reputation or anticipated savings, arising out of or relating to your use of, or inability to use, the Service.

To the fullest extent permitted by applicable law, EILO.org's total liability for any claim arising out of or relating to the Service shall be limited to the amount, if any, paid by you directly to EILO.org for the specific Service giving rise to the claim during the twelve (12) months preceding the event giving rise to the liability, or, if no such payment was made, a nominal amount of one hundred euro (EUR 100).

Nothing in these Terms excludes or limits liability where such exclusion or limitation is not permitted by applicable law.

12. Indemnity
To the extent permitted by applicable law, you agree to indemnify and hold harmless EILO.org, its operators, administrators, contractors and representatives from and against claims, demands, liabilities, damages, losses and reasonable costs arising out of or related to:
- your breach of these Terms;
- your misuse of the Service;
- your submitted content;
- your violation of the rights of any third party.

13. Termination or restriction
EILO.org may suspend, restrict or terminate your access to the Service, remove your account, reject future submissions, or take technical or administrative measures at any time if EILO.org believes that:
- you have violated these Terms;
- your conduct creates legal, technical, operational or reputational risk;
- a complaint, legal request or rights issue requires action;
- continued access is no longer appropriate for operation of the Service.

14. Privacy
Personal data collected through the Service is handled in accordance with the Privacy Policy.

15. Changes to these Terms
EILO.org may amend these Terms from time to time by publishing an updated version on this page. Continued use of the Service after updated Terms become effective constitutes acceptance of the revised Terms.

16. Governing law and jurisdiction
These Terms shall be governed by and interpreted in accordance with the laws of Estonia, unless mandatory consumer protection laws or other mandatory laws require otherwise.

Any dispute arising out of or in connection with these Terms shall be submitted to the competent courts of Estonia, unless applicable mandatory law provides otherwise.

17. Severability
If any provision of these Terms is found invalid, unlawful or unenforceable, the remaining provisions shall remain in full force and effect to the extent permitted by law.
